A NEW CONSOLIDATED COMPREHENSIVE ZONING BY-LAW

NOTICE OF THE PASSING OF A ZONING BY-LAW
BY THE CORPORATION OF THE TOWNSHIP OF CHATSWORTH

TAKE NOTICE that the Council of the Corporation of the Township of Chatsworth will pass an amended Comprehensive Zoning By-law No. 2007-39 on the 15 day of August, 2007 under Sections 34, 36 and 39 of The Planning Act, R.S.O. 1990, as amended.

AND TAKE NOTICE that any person or agency may appeal to the Ontario Municipal Board in respect of the By-law by filing with the Clerk of the Corporation of the Township of Chatsworth not later than the 28th day of August, 2006 a notice of appeal setting out the objection to the By-law and the reasons in support of the objection.

ONLY individuals, corporations and public bodies may appeal a Zoning By-law to the Ontario Municipal Board. A notice of appeal may not be filed by an unincorporated association or group. However, a notice of appeal may be filed in the name of an individual who is a member of the association or the group on its behalf.

EXPLANATORY NOTE
NOTICE OF PASSING OF A ZONING BY-LAW BY THE CORPORATION OF THE
TOWNSHIP OF CHATSWORTH

Preamble

This Zoning By-law was passed under Sections 34, 36 and 39 of The Planning Act, R.S.O. 1990, as amended. The Zoning By-law is comprised of both text and zoning schedules on which are delineated the various zones created by the By-law.

Purpose

The purpose of this By-law is to provide the Corporation of the Township of Chatsworth with regulations which will effect control over all forms of land use or the character and location of buildings and structures in Conformity with the County of Grey Official Plan. Such regulations have been deemed necessary and in the public interest by Council, in order that possible conflicts are reduced in the future.

From the date of the coming into force of this By-law, all previous by-laws passed under Sections 34, 36 and 39 of The Planning Act, R.S.O. 1990, as amended or predecessor thereof, shall be deemed to have been repealed. All previous by-laws, including those passed under Section 34 of The Planning Act, R.S.O., as amended, or predecessor within the former Village of Chatsworth, Township of Holland and Township of Sullivan, shall be deemed to have been repealed.

Affected Lands

The lands directly affected by this By-law can be described as consisting of all properties lying wholly or partly within the Corporation of the Township of Chatsworth.

Duration

It is the intention of the Council that this Zoning By-law will be effective until circumstances change to such a degree that a revision and updating of the By-law is required.

Effect

This Zoning By-law is designed to regulate, by prohibition, all new development, except that specifically permitted in the By-law. This By-law, however, gives Council the legal authority to review the merits of any new use which is not specifically allowed by the By-law. If Council, after studying a proposal for a new use, is satisfied that the new use is in the best interest of the Municipality and is in conformity with the applicable policies of the County of Grey Official Plan, then the new use may be permitted, provided that an implementing By-law amending this By-law be passed, which would permit the new use on the specified parcel of land, subject to appropriate regulations.
